Law of the People's Republic of China on Government Punishment for Public Officials

(Adopted at the 19th meeting of the Standing Committee of the 13th National People's Congress on June 20, 2020)

Chapter 1 General Provisions

Article 8 The period of government sanctions is:

Chapter 3 Illegal acts and applicable government sanctions

Article 37: Using clan or evil forces to oppress the masses，Or indulgence、Covering the activities of evil forces，Removed；Serious circumstances，Expelled。

Chapter 4 Procedures for Government Punishment

Article 42: Supervisory agencies investigate public officials suspected of violating the law，Should be carried out by more than two staff members。When the supervisory authority conducts an investigation，The right to inquire about the situation from relevant units and individuals in accordance with the law，Collect、Retrieve evidence。Relevant units and individuals should truthfully provide information。

Article 47: Participating in investigations of illegal cases involving public officials、The person being handled has one of the following situations，Should avoid it yourself，Respondent、The whistleblower and other relevant personnel also have the right to request that they recuse themselves:

(1) A close relative of the person under investigation or the reporter；

(2) Those who have served as witnesses in this case;

(3) The person or his close relatives have an interest in the case under investigation；

Article 48 Recusal of the person in charge of the supervisory authority，Decided by the superior supervisory authority；Others involved in investigation of illegal cases、Avoidance of handlers，Decided by the person in charge of the supervisory authority。

(3) Improper government sanctions.

Public officials who violate Article 57 of this Law、The government sanctions are revoked or the government sanctions are reduced under the circumstances specified in Article 58，Should be compensated for the loss of their remuneration。

Chapter 6 Legal Liability

Article 61 Relevant Agencies、The unit refuses to adopt supervision recommendations without justifiable reasons，By its superior authority、The competent authority orders correction，To this agency、The unit gives a notice of criticism，Responsible leaders and directly responsible personnel will be dealt with in accordance with the law。

Article 62 Relevant Agencies、Unit、The organization or person has one of the following situations，By its superior authority，Competent authority，Appointment and removal authority、Ordered by the unit or supervisory authority to make corrections，Handle according to law:

(1) Refusal to implement government sanctions;

(2) Refusing to cooperate or obstructing the investigation;

(3) Against the whistleblower、Retaliation by witnesses or investigators；

(4) False accusations and frame-ups against public officials;

(5) Other situations that violate the provisions of this law.

Article 63 Supervisory agencies and their staff have any of the following circumstances，Responsible leaders and directly responsible personnel will be dealt with in accordance with the law:

(1) Violating regulations to deal with clues to problems;

(2) Stealing、Leaking investigation work information，Or leak the report matter、Report acceptance status and whistleblower information；

Chapter 7 Supplementary Provisions

Article 66 The Central Military Commission may formulate relevant specific regulations in accordance with this law。

Article 68 This Law shall come into effect on July 1, 2020。
